Terms of Use: DartScore+

Scope

These terms of use govern the use of the app DartScore+ ("app"), provided by Xinger Solutions GmbH, Seefeldgasse 5, 3462 Absdorf, Austria ("we"). By installing or using the app, you agree to these terms. The terms of the app store from which you downloaded the app apply in addition.

Licence

We grant you a free, non-exclusive, non-transferable right to use the app for personal, non-commercial purposes on devices you own or control. You may not copy, modify, decompile or redistribute the app, except where mandatory law allows it.

Availability and updates

We develop the app continuously and may change, extend or discontinue features. We aim for the app to work reliably but cannot guarantee uninterrupted availability or compatibility with every device and operating system version.

Liability

The app is provided free of charge. We are liable without limitation for intent, gross negligence and personal injury. For slight negligence, we are liable only where mandatory law, in particular the Austrian Consumer Protection Act (KSchG), requires it. Results shown in the app, such as scores, statistics or random results, are provided without guarantee.

Intellectual property

All rights to the app, including its design, texts, graphics and code, remain with us or our licensors.

Governing law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country in which you have your habitual residence. The place of jurisdiction is determined by mandatory statutory provisions.

Changes to these terms

We may update these terms, for example when we add features or the law changes. Each update is published as a new version with the date from which it applies. Earlier versions remain available in the version history.
