Terms of Use: Water Flow 3D: Pipe Puzzle

Scope

These terms of use govern the use of the app Water Flow 3D: Pipe Puzzle ("app"), provided by Xinger Solutions GmbH, Seefeldgasse 5, 3462 Absdorf, Austria ("we"). By installing or using the app, you agree to these terms. The terms of the app store from which you downloaded the app apply in addition.

Content

We create the content of this website with care but cannot guarantee that it is complete, correct and up to date. As far as legally permissible, our liability for content is limited to intent and gross negligence.

In-app purchases

Some features can be unlocked through in-app purchases. Prices are shown in the app store before you buy. The purchase is concluded and processed through Google Play or the Apple App Store; their terms apply to payment and refunds.

In-app purchases are digital content. By confirming the purchase, you request that we start providing it immediately and acknowledge that your right of withdrawal ends once delivery has started (§ 18(1)(11) FAGG). Refunds can be requested from the store operator according to its policies. Purchases are linked to your store account and can be restored on other devices that use the same account.

Advertising

The app is free and may show ads. Ads are supplied by third parties; we are not responsible for their content. The privacy policy explains how data is processed for advertising.

Availability and updates

We develop the app continuously and may change, extend or discontinue features. We aim for the app to work reliably but cannot guarantee uninterrupted availability or compatibility with every device and operating system version.

The website links to external sites such as app stores. We have no influence on their content and are not responsible for it. If we become aware of unlawful content on a linked site, we will remove the link.

Liability

The app is provided free of charge. We are liable without limitation for intent, gross negligence and personal injury. For slight negligence, we are liable only where mandatory law, in particular the Austrian Consumer Protection Act (KSchG), requires it. Results shown in the app, such as scores, statistics or random results, are provided without guarantee.

Intellectual property

All rights to the app, including its design, texts, graphics and code, remain with us or our licensors.

Texts, graphics and logos on this website are protected by copyright. Using them beyond private purposes requires our prior consent. You are welcome to link to the website.

Governing law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country in which you have your habitual residence. The place of jurisdiction is determined by mandatory statutory provisions.

Changes to these terms

We may update these terms, for example when we add features or the law changes. Each update is published as a new version with the date from which it applies. Earlier versions remain available in the version history.
